What Documents Are Required For A Divorce In India?

Divorce is an important decision with many legal and emotional implications. In India, divorce laws vary depending on whether it is a mutual divorce or a contested divorce. Also, there are different personal laws for each religion. Proper documentation is crucial for a smooth divorce process, regardless of the type.

This article provides an overview of all the necessary documents for filing a divorce in India and offers some insight into the country’s legal framework.

There Are Different Types Of Divorces In India

Before diving into the required documents, you should first understand the two primary divorce types in India.

  1. Mutual Consent Divorce:
    • Both spouses must agree to the separation.
    • Typically, a loan is approved within 6-18 months.
    • It is governed under Section 13B (Hindu Marriage Act) of 1955, as well as applicable laws for all other religions.
  2. Contested Divorce:
    • When one spouse divorces without the other's consent.
    • The legal process can take several years.
    • Common grounds for divorce include adultery (including cruelty), desertion (including conversion), mental disorder, and irretrievable marriage breakdown.

For any divorce, a certain set of legal documents is required to begin and complete the divorce procedure in India.

Important Documents Required For Divorces In India

The documents needed for divorce vary depending on whether there is a reason for separation, and what personal laws apply. Following is a comprehensive list of the documents required:

  1. Address Proof Of Both Spouses
  • Aadhar Card
  • Passport
  • Voter ID
  • Ration Card
  • Utility bills
  • Rent agreements or property documents

If you want to know where your case should be heard, the court needs proof of your address.

  1. Identity Proof Of Both Parties
  • PAN Card
  • Aadhar Card
  • Passport
  • Driver's license
  • Any other government-issued identification document

A valid identity proof is required to confirm that the divorcees are the real people who filed for divorce.

  1. Marriage Certificate
  • Issued by the Marriage Registrar's Office pursuant to the Hindu Marriage Act (1955) or Special Marriage Act (1954).
  • Serving as proof of marriage.

If the marriage certificates are not available, you may need to provide alternative proofs such as wedding photographs, invitations, or witness declarations.

  1. Photographs Of The Wedding
  • Wedding photographs can be used to prove marriage.
  • If a marriage certificate is not available, these documents can still be used to confirm the marital status.

  1. Proof Of Marriage Duration
  • Marriage Certificate
  • Wedding invitation card
  • Affidavit detailing the duration of cohabitation

Before filing for divorce, the court needs proof that both parties have been married at least for a specified period (usually one calendar year).

  1. Proof Of Separation Period For Mutual Divorce
  • Documents show that the couple has lived apart for a minimum of one year.
  • Utility bills and rental agreements are acceptable as proof.

For mutual consent divorces, the couple must have been separated for at least a year before filing the petition.

  1. Both Spouses Must Provide Proof Of Income
  • Salary slips from the last six months
  • Income Tax returns (ITRs) of the previous 3 years
  • Bank Statements
  • Business Documents (if self-employed).

Income proof is needed to determine alimony (maintenance), child support, and child maintenance.

  1. Property And Asset Documents
  • Information about properties that are jointly or privately owned.
  • Details about your bank account, investments, insurance policies, and mutual funds.
  • Documents relating to loan documents and their liabilities

In divorce cases contested, there are often property disputes that require disclosure of financial information.

  1. Proof Of Cruelty / Other Grounds

Evidence is key in contested divorces. These can include:

  • Medical reports in the case of domestic violence and mental illness
  • Police complaints, or FIRs.
  • Email/SMS/Call Recordings (if applicable).
  • Witness statements are used to back up the claim.

The court must evaluate these proofs to grant a divorce contested.

Conclusion

Divorce involves a complex legal procedure. By having the proper documents, you can expedite and prevent delays. If you want to file for a mutually agreed divorce or one that is contested, you must gather all necessary documents and consult a professional lawyer when necessary.

Consult a lawyer before you consider divorce. They can assist you in ensuring your rights are upheld and that all legal obligations are fulfilled. Understanding the documentation process will make the experience less stressful.
